Maintaining Your Permanent Residence Status
A lawful permanent resident is required to uphold their status in Canada. The individual must be living in Canada for at least two years out of a five-year period, since they became permanent residents. The only way to be exempt from this rule is, if
- The Permanent Resident is co-existing with a Canadian citizen spouse or common-law partner;
- The Permanent Resident holder is a child under the age of 22 years, accompanying a Canadian citizen or permanent resident parent;
- The Permanent Resident is working on a full-time basis with a Canadian business, the public service of Canada (or Canadian province); or
- The Permanent Resident holder is a child under the age of 22 years, accompanying a parent who is employed on a full-time basis by a Canadian company, the public service of Canada or the public service of a Canadian province outside Canada.
Follow these rules and you won’t lose your status as a permanent resident of Canada. If you do not comply with the residency duties, an order may be issued by the Canadian government causing you to lose or abandon your status. If the individual fails to meet the obligations, they may be required to leave Canada.
